Job Title: Senior Legal Manager – Real Estate

Key Responsibilities

Litigation & Dispute Resolution

  • Represent the company in legal proceedings, including property disputes, RERA cases, consumer complaints, and arbitration matters.
  • Handle litigation related to real estate transactions, land acquisition, tenancy disputes, and regulatory issues.
  • Coordinate with external legal counsel and appear before courts, tribunals, and regulatory authorities.
  • Ensure timely resolution of legal disputes to protect the company’s interests.

Mutation & Title Due Diligence

  • Oversee the mutation process to ensure smooth property ownership transfers.
  • Conduct title searches, due diligence, and property verification before acquisitions or sales.
  • Ensure compliance with land records, municipal authorities, and government agencies.

Drafting & Documentation

  • Draft, review, and negotiate agreements, including:
    • Sale Deeds
    • Lease & Rental Agreements
    • Development Agreements
    • Joint Ventures
    • Vendor & Contractor Contracts
  • Ensure error-free documentation to protect the company’s legal interests.
  • Handle documentation for RERA, municipal approvals, and regulatory compliance.

Legal Compliance & Risk Management

  • Ensure adherence to real estate laws, including:
    • RERA Act
    • Transfer of Property Act
    • Stamp Duty & Registration Laws
    • Municipal & Land Laws
  • Advise management on legal risks, compliance issues, and regulatory changes.
  • Implement strategies to minimize legal exposure and safeguard company assets.

Negotiation & Advisory

  • Negotiate with buyers, sellers, tenants, government bodies, and vendors to secure favorable terms.
  • Provide legal opinions on real estate transactions, contracts, and strategic deals.
  • Work closely with the sales, leasing, and operations teams to structure transactions effectively.

Who Can Be Present in Court for Legal Matters?

For real estate litigation, the following individuals may attend court proceedings:

1. Legal Representatives:

  • Advocate/Lawyer – Licensed professional representing the company.
  • In-House Legal Counsel – If the company has an internal legal team.

2. Company Representatives:

  • Authorized Signatory – A senior official (Director, Legal Head, CEO) with legal authority.
  • Power of Attorney (PoA) Holder – If someone has been given legal PoA to represent the company.

3. Witnesses & Experts:

  • Key Witnesses – Individuals involved in the transaction (buyers, sellers, tenants, or employees).
  • Expert Witnesses – Property valuers, surveyors, or auditors for technical input.

4. Opposing Party & Their Representatives:

  • The plaintiff (who filed the case) or the defendant (against whom the case is filed), along with their lawyers.

5. Court Officials:

  • Judge – Presides over the case.
  • Court Clerk & Staff – Manage case records.
  • Public Prosecutor – If criminal aspects are involved (e.g., fraud or land disputes).

Note: Senior company officials typically do not attend unless:

  • The judge specifically requires their presence.
  • A settlement or negotiation is happening in court.
  • They need to testify as witnesses.

Key Requirements

Qualifications: LLB/LLM from a reputed university.
Experience: 8+ years in real estate litigation, mutation, compliance, contract drafting, and negotiation.
Skills:

  • Strong negotiation and communication abilities.
  • Expertise in real estate laws, contract laws, and dispute resolution.
  • Ability to work with regulatory bodies, municipal corporations, and courts.
    Preferred Background: Candidates from real estate firms, law firms handling property matters, or corporate legal departments in real estate.
